Parties
This Moving Services Agreement (“Agreement”) is entered into by
Last Stop Moving (“Company”) and the undersigned customer (“Customer”).
Scope of Services
On the agreed moving date, Last Stop Moving will:
- Arrive at the moving site with necessary packing supplies and vehicles.
- Pack all items securely and appropriately.
- Load items with care to prevent damage during transport.
- Deliver items to designated locations.
- Reassemble furniture disassembled for the move.
- Place furniture and items in requested positions.
- Unpack items based on customer guidance.
- Remove and dispose of all packing materials.
The Customer agrees to:
- Ensure legal ownership and rights to all items being moved.
- Be present during the move, especially at the delivery location.
- Separate items not intended for transport.
- Ensure walkways and driveways are clear and safe for movers.
- Verify inventory accuracy before and after the move.
Duration of Services
Services commence on the agreed date and time. The duration is billed hourly, factoring in conditions like traffic and site accessibility.
Rate of Service
The hourly rate applies to the total time from the start to the end of services. Any additional services or changes to the original scope will incur extra charges, as outlined in the final invoice.
Deposit and Payment
- A $100 deposit is required to confirm the booking.
- The deposit will be refunded if services cannot be provided due to the Company’s fault.
- Final payment is due upon delivery of the final invoice. Accepted methods include cash, debit/credit card, or e-transfer.
Customer Obligations
- The Customer is responsible for parking arrangements and clearing pathways, especially in winter.
- Valuable or irreplaceable items, such as jewelry or artwork, should not be included in the move.
- The Customer is responsible for backing up any data stored on items being moved.
- Customers must not interfere with movers or assist in carrying items during the move.
Liability for Damage
- The Company’s liability for damaged items is limited to $0.60 per pound per item.
- The Company is not liable for damages caused by pre-existing conditions, improper packing by the Customer, or fragile items like marble, ceramics, or pressed wood furniture.
- The Company will not be responsible for damages to walls, floors, or fixtures during non-routine moving situations.
Claims and Complaints
Claims for damages must be filed within 14 days of the move. Failure to file within this period waives the right to any compensation.
Force Majeure
The Company is not liable for delays or damages caused by unforeseen events, such as natural disasters, road closures, or extreme weather conditions.
Indemnification
The Customer agrees to indemnify the Company and its employees against any claims, damages, or liabilities arising during the move.
Entire Agreement
This Agreement constitutes the complete understanding between the parties and supersedes all prior agreements.
Governing Law and Dispute Resolution
This Agreement is governed by the laws of Alberta, Canada. Any disputes will be resolved through arbitration under the Canadian Arbitration Association.
